Do I have to pay school fees on an ADU in Los Angeles?
Most Valley homeowners building one do 16. School districts in California may charge a fee on new homes and on other residential construction that adds more than 500 square feet of assessable space 2. In the City of Los Angeles that fee goes to LAUSD, and it must be paid before the Department of Building and Safety (LADBS) issues your building permit 10.
The fee is separate from the plans and permits you pay the city for. LAUSD collects it itself through its Developer Fee Program Office, and LADBS will not clear your permit until you bring back the district's receipt 9. Is my ADU small enough to skip the school fee?
If it has less than 500 square feet of interior living space, yes. SB 543, in effect since January 1, 2026, added a sentence to Government Code section 66311.5 that treats any ADU or junior ADU under 500 square feet as construction that does not increase assessable space by 500 square feet 1. The Education Code only lets a district charge that kind of construction when the increase is more than 500 square feet 2. LAUSD's own refund form already listed projects of less than 500 square feet of total assessable space as a possible exemption 12.
Two details matter when you are close to the line:
- The fee is not charged only on the space over 500. When the fee applies, it applies to the total increase in assessable space 2. A 499 sq ft unit owes nothing, and a 600 sq ft unit owes the rate on all 600 square feet.
- A larger ADU can be charged either way. Above the threshold, a district may levy the fee as new residential construction or as other residential construction, whichever fits the project 13.

How much is the LAUSD school fee per square foot in 2026?
LAUSD's 2024 payment instructions used $5.17 per square foot for residential construction, with a worked example of 1,000 square feet owing $5,170 7. State law caps this fee and raises the cap every two years at the State Allocation Board's January meeting 4. On January 28, 2026, the board raised the residential cap from $5.17 to $5.38 per square foot of assessable space 5.
LADBS then announced that LAUSD would put new Level 1 developer fee rates into effect starting August 11, 2026, following that state increase 6. LAUSD posts the exact new schedule on its own impact fee site, so read the current rate there before you budget. Here is what the fee comes to at the old rate and at the new state cap:
- 499 sq ft: $0 at either rate, because the unit is under 500 square feet 1.
- 600 sq ft: $3,102 at $5.17, or $3,228 at $5.38.
- 800 sq ft: $4,136 at $5.17, or $4,304 at $5.38.
- 1,200 sq ft: $6,204 at $5.17, or $6,456 at $5.38.
Those are the rate times the square footage, the same way LAUSD tells you to calculate it 7. The square footage that counts is the number LADBS certifies, not the one on a builder's brochure 8.

It can. State law defines assessable space as the square footage inside the perimeter of a residential structure, and it leaves out garages, carports, patios and detached accessory structures 3. A garage is therefore not assessable space today. Once it becomes a living unit, its floor area becomes living space, so a garage conversion of 500 square feet or more can be charged the fee on that area 23.
The same law says the building department that issues your permit measures the square footage, using its own standard practice 3. In Los Angeles that is LADBS, which fills in the square footage on LAUSD's certification form before you can pay 8. Before you design one, check that the garage was permitted.
I read that ADUs under 750 square feet pay no impact fees. Doesn't that cover school fees?
No, school fees have their own threshold. The 750 square foot rule bars a local agency, special district or water corporation from charging impact fees on an ADU of 750 square feet or less 15. Most California school districts took the view that this rule did not apply to them, because a school district is neither a local agency nor a special district 14.
SB 543 settled the question for small units by writing the 500 square foot rule into the same section of law, tied directly to the Education Code 1. So an ADU between 500 and 750 square feet can owe nothing to the city in impact fees and still owe LAUSD its school fee. The Reseda cost guide walks through the city side.
How many Valley ADUs are big enough to owe the school fee?
Most of them. We sorted 1,560 new ADU building permits issued in 35 San Fernando Valley ZIP codes from January 2025 through September 2026 by the floor area listed on the permit 16:
- Under 500 sq ft: 120 permits, or 7.7%.
- 500 to 750 sq ft: 248 permits, or 15.9%.
- More than 750 sq ft: 1,192 permits, or 76.4%.
The median permit listed 1,040 square feet 16. At the new state cap of $5.38 5, that size comes to about $5,595 in school fees, and at the 2024 rate of $5.17 7 it comes to about $5,377. The permit's listed floor area is not always the same as LADBS's certified assessable space, so treat these as a guide to how often the fee applies, not as a quote for your project 16. How and when do I pay LAUSD, and can I get money back?
You pay after LADBS has measured the project and before it issues the permit 10. LAUSD's instructions run in this order 89:
- Ask your LADBS office for the "Certification of Payment of School Impact Fees" form, and fill in and sign Part I.
- Have LADBS complete Part II, which certifies the square footage. LAUSD will not process your payment without it.
- Pay LAUSD the rate times that square footage.
- Take the countersigned form and LAUSD's green receipt back to LADBS to clear the permit.
If you shrink the project or cancel it after paying, LAUSD's policy says a written request for a refund or protest must reach its Developer Fee Program Office within 90 calendar days of the payment 11. Its form lists "less than 500 sq. ft." and "reduced square footage" among the grounds for a possible refund 12. Whether your lot can fit a unit under or over 500 square feet is the kind of thing a lot check settles before you pay for drawings.
